About the CAXFlix service

CAXFlix is a curated audiovisual streaming, rental and purchase service. It is not a torrent, peer-to-peer, file-sharing, cyberlocker or user-generated-content service. Users cannot upload, publish, seed, distribute or add films or other media to the public catalogue.

Because CAXFlix does not accept user uploads, procedures aimed at identifying an uploading user, terminating repeat uploaders or restoring a user's removed upload do not describe the operation of this service. A rights notice must instead identify the specific catalogue title, artwork, trailer, metadata or CAXFlix page concerned.

Applicable-law position

Caxess Corporation is based in the Republic of Belarus. Subject to any mandatory law that applies in a particular case, notices and claims are assessed under applicable Belarusian law and through the competent authorities and courts of the Republic of Belarus.

The United States Digital Millennium Copyright Act is a United States statutory procedure. Submission of a notice described as a “DMCA notice” does not, by itself, establish that the procedure governs Caxess Corporation, create Belarusian liability, amount to acceptance of United States jurisdiction, or displace the requirements of applicable Belarusian law.

Belarusian Law No. 241-Z of 3 January 2023, “On Restriction of Exclusive Rights to Intellectual Property Objects”, establishes defined limitations and remuneration mechanisms in specified circumstances involving rightsholders connected with states designated as committing unfriendly actions. Its application depends on the statutory criteria, designated lists, permitted categories of use, and applicable remuneration and reporting requirements.

Caxess Corporation reserves every permission, limitation, compulsory-remuneration mechanism, defence and exception available under Law No. 241-Z and other applicable law. The interpretation and application of those provisions to any particular work, rightsholder, territory or notice are legal matters handled on behalf of Caxess Corporation by 227 Law.

Requirements for a rights notice

To permit a fair and efficient review, a notice should be specific, complete and supported by evidence. It should include:

1. the sender's full legal name, organisation, postal address and working email address;
2. proof that the sender owns the relevant rights or is expressly authorised to act for the rightsholder;
3. precise identification of each protected work and the territory in which rights are asserted;
4. the exact CAXFlix page URL, catalogue title and any other information needed to identify the material;
5. the legal basis relied upon, including the law and jurisdiction said to apply;
6. a clear explanation of the alleged infringement and the specific remedy requested;
7. a good-faith statement that the information supplied is accurate, complete and not materially misleading; and
8. the dated physical or valid electronic signature of the rightsholder or authorised representative.

Blanket notices, automated URL lists, unsupported assertions, notices sent by persons without authority, or demands that do not identify the applicable rights and territory may be returned for clarification or rejected as incomplete.

Review and response

Receipt of a notice is not an admission of ownership, infringement, jurisdiction, liability or the availability of any requested remedy. Caxess Corporation and 227 Law may request further documents, verify authority and chain of title, investigate territorial licensing and applicable statutory permissions, preserve evidence, restrict, de-index, replace or remove material where legally appropriate, or reject a notice that is inaccurate, abusive or legally insufficient.

False, fraudulent or materially misleading notices may be documented and referred to the appropriate advisers, service providers, regulators or authorities. All rights and remedies are expressly reserved.

No waiver or service of proceedings

Publishing an email address for notices does not appoint an agent under any foreign statute, waive objections to jurisdiction or service, consent to electronic service of court proceedings, or vary any limitation, defence or procedural requirement available to Caxess Corporation. Formal service of legal proceedings must comply with the law and procedure applicable to the proposed service.
